Mumbai: An affidavit was submitted by the petitioner's counsel along with an annexure containing defamatory material in the film Omkara before the City Civil Judge AT Vaidya.The court was informed by Counsel MV Holmagi that despite the court's order, the petitioner was not allowed to record objectionable material of the said film.
Hence, an affidavit in this regard, along with the transcript material from the memory of the petitioner, was submitted.
Additionally, he requested the court to issue directions to the defendant to produce objectionable material before the court; however, the court rejected the request on the grounds it is for the plaintiff to provide the defamatory material, not the court.
The Court directed the counsel for the plaintiff to furnish copies of the affidavit and annexure to the defendant's counsel, and then adjourned the matter for hearing until Friday. Since the plaintiff had not annexed the alleged defamatory material along with his application, the court yesterday "granted permission to the plaintiff to see the movie and take the material", enabling the court to pass necessary orders in the matter.
The petitioner, a smalltime actor, has filed the petition in order to seek the court's directive to ban the film, as well as prosecute producer of the film Kumar Mangat, Devgan films, as well as Director Vishal Bharadwaj and others.
It is his contention that close to 45 miniutes of the film contains swear words.
Omkara is an adaptation of Shakespeare's 'Othello'. It stars Ajay Devgan, Kareena Kapoor, Saif Ali Khan, Vivek Oberoi, Nasserudin Shan.
